Regarding the legality of refusing service to people based on their sexual orientation.

Homosexuality is not a protected class under federal law, so there’s nothing in federal statutes or case law that prohibits private actors (such as restaurants) or, for that matter, public actors (such as the military) from refusing service or entry to gay people.

Federal law prohibits discrimination based on race, religion, disability, gender, etc., not only by the government (the Constitution only restricts government actions) but also private actors, under the general provisions of the Commerce Clause, which allows government intrusion by regulation on the choices of private actors. 

The best that the Supreme Court has so far come up with is that it’s unconstitutional for states to pass laws that prohibit people from engaging in homosexual acts in the privacy of their own homes, but that was really quite recent.

One big reason that protections for sexual orientation have never been instituted is that this would result in it being illegal for the military to disciminate against gay people, and so far, no one has had the balls to just eliminate that restriction.

So while I can’t vouch for the accuracy of the statement that more than half of the states allow restaurants to refuse service to gay people, since there’s no federal law that applies nationwide, such discrimination is legal unless state law forbids it.  And most states aren’t together enough to pass laws like that.  So it wouldn’t surprise me, quite frankly.

Thanks for that info. I thought it had something to do with how those laws worked in the US. I’m Canadian and it made me curious about what our laws are and its actually written explicitly that discrimination of sexual orientation is illegal in the Candian Human Rights Act which regulates private businesses.

Great epsiode. I was listening late last night and Seth’s whole thing about dying unexpectedly really got to me. I also thought it was funny when the guys acknowledged the whole suppossed farting incident.
